When arrested in Canada, you have fundamental rights protected by the **Canadian Charter of Rights and Freedoms**.

### Right to Silence

You have the absolute right to remain silent. You are not required to answer police questions beyond providing your identity. **Anything you say can be used against you in court.**

### Right to Counsel

Upon arrest, you have the right to consult a lawyer without delay. Police must:

- Inform you of your right to a lawyer
- Provide access to a telephone
- Cease all questioning until you have consulted a lawyer
