    Appearance, Preliminary Inquiry and Trial

Understand court appearances, preliminary inquiries and criminal trials. Learn how a defence lawyer prepares you for each stage.

    Appearance, Preliminary Inquiry and Trial

The Quebec criminal justice system has several key stages. Understanding the difference is essential.

    Court Appearance

Your first appearance before the court:

    • Charges are officially read
    • You can enter a plea (guilty or not guilty)
    • Your lawyer can request bail release
    • Release conditions may be imposed
    • The case is adjourned for disclosure

    Preliminary Inquiry

Held for serious indictable offences to determine if there is enough evidence for trial:

    • The Crown presents witnesses and evidence
    • Your lawyer can cross-examine Crown witnesses
    • The judge determines if committal to trial is warranted

A valuable strategic tool for the defense.

    Criminal Trial

The final stage where guilt or innocence is determined. You may choose a judge-alone trial or jury trial:

    • Crown presents its case
    • Your lawyer cross-examines each witness
    • Defense may present its own evidence
    • Both parties make final submissions
    • Judge or jury renders the verdict

The Crown must prove guilt beyond a reasonable doubt.
