Your Rights During an Arrest
Right to silence, right to counsel, search and seizure — knowing your fundamental rights from the first contact with police is essential for your defense.
Your Rights During an Arrest
When arrested in Canada, you have fundamental rights protected by the Canadian Charter of Rights and Freedoms.
Right to Silence
You have the absolute right to remain silent. You are not required to answer police questions beyond providing your identity. Anything you say can be used against you in court.
Right to Counsel
Upon arrest, you have the right to consult a lawyer without delay. Police must:
- Inform you of your right to a lawyer
- Provide access to a telephone
- Cease all questioning until you have consulted a lawyer
- Inform you about Legal Aid
Mahmoud Avocats is available 24/7 for emergency calls.
Protection Against Unreasonable Search
Section 8 of the Charter protects you against unreasonable search and seizure. Police generally need a search warrant. If a search is conducted illegally, the evidence may be excluded at trial.
Right to Know the Reasons for Arrest
Police must promptly inform you of the reasons for your arrest and the charges against you.
Right to a Prompt Court Appearance
You must be brought before a judge within 24 hours of your arrest.
If Your Rights Are Violated
Your lawyer can seek exclusion of illegally obtained evidence under Section 24(2) of the Charter, potentially leading to acquittal.
